Your Dog Smiles Pet Services, LLC- Policies & Service Agreement This Agreement is between Your Dog Smiles Pet Services, LLC (“YDSPS”) and the undersigned Client (“Client”).
A. Purpose & Authorization
1. Purpose. This Agreement sets the duties and obligations of YDSPS and Client for the care and handling of Client’s pet(s) (each a “Pet,” collectively “Pets”) as described in Client’s Precise Petcare profile (the “Profile”).
2. Authorization. Client authorizes YDSPS, its sitters and representatives (together, “YDSPS Parties”) to: (a) enter Client’s home at scheduled service times; (b) provide feeding, water, medication, litter/waste care, and general care; (c) walk/exercise Pets in designated locations and public areas; and (d) transport Pets when reasonably necessary for services or emergencies.
B. Limits of Liability; Indemnification (Virginia)
1. Standard of Care. YDSPS will exercise reasonable care and take reasonable precautions with Pets and Client property.
2. Assumption of Risk. Client understands pet care carries inherent risks, including illness, injury, escape, self‑inflicted injury, destructive behavior, house soiling, and damage to property or other animals/people. Client agrees to store valuables/sentimental items safely.
3. Waiver & Release. To the fullest extent permitted by Virginia law, Client waives and releases YDSPS and all YDSPS Parties from liability for any loss, damage, injury, or claim related to the Pets or this Agreement (collectively, “Covered Claims”), except to the extent caused by YDSPS’s or a YDSPS Party’s gross negligence, recklessness, or intentional misconduct.
4. Indemnification. To the fullest extent permitted by law, Client will defend, indemnify, and hold harmless YDSPS and YDSPS Parties from third‑party Covered Claims, including reasonable attorney’s fees and costs, arising from: (a) the acts, behavior, or condition of Pets; (b) inaccurate/incomplete information provided by Client; or (c) Client’s breach of this Agreement.
5. Client Responsibility. Client is solely responsible for harm or illness caused by Pets while in YDSPS’s care, except as limited in B(3) above.
C. Emergencies
1. First Aid/CPR. Some YDSPS sitters are trained in pet CPR/first aid and may render aid in good faith. Client agrees to hold YDSPS and YDSPS Parties harmless for such emergency efforts.
2. Veterinary Care. If YDSPS, in good faith, deems emergency medical care necessary and cannot promptly reach Client, YDSPS may obtain treatment from any licensed veterinarian or emergency facility. Client will reimburse all expenses within one (1) business day. YDSPS recommends keeping a credit card on file with Client’s veterinarian or with YDSPS for emergency use only. An emergency medical transport fee may apply.
3. Emergency Treatment Plan. Client will keep a current Emergency Treatment Plan on file with YDSPS.
4. YDSPS Discretion in Emergencies. Client understands problems that develop with Pets will be treated as deemed best by YDSPS and its sitters; Client assumes full financial responsibility for any and all expenses.
D. Online Account & Policies
1. Portal Use. When using the client portal (Precise Petcare) to schedule or make changes, Client agrees to this Agreement and to all YDSPS policies posted in the portal and on the YDSPS website.
2. Policy Updates. YDSPS may update policies from time to time and will provide notice via the portal (Precise Petcare), email, and/or website alerts. Continued use of services constitutes acceptance of updates.
E. Parking
1. Parking Expectation. Client is encouraged to provide adequate, safe parking for sitters. If safe parking cannot be found in an efficient time, visit time may be reduced to compensate; if the search extends past the visit, an additional fee may be charged for sitter time.
2. Paid Parking. If Client cannot provide parking or a pass, paid parking will be billed to Client at 10% over the actual price to cover compensation and processing fees.
F. Photos
Client authorizes YDSPS and sitters to take photos of Pets for Client’s file. Unless Client opts out in writing, photos may be used on YDSPS websites, social media, and marketing materials. All photos are the property of YDSPS.
G. Termination
Client must request termination in writing to petcare@yourdogsmiles.com. YDSPS may terminate service at any time; YDSPS will take reasonable measures to ensure the safety of Pets.
H. Sitter Injury/Illness; Coverage
If a sitter is injured/ill or otherwise unable to perform duties, Client authorizes YDSPS to arrange a qualified backup sitter to perform services per this Agreement.
I. Non‑Solicitation
Client understands YDSPS sitters operate under restrictive covenants. Client agrees not to directly hire or solicit any YDSPS sitter who provided services to Client to perform pet care outside YDSPS while associated with YDSPS and for twelve (12) months thereafter. Report suspected violations to YDSPS immediately.
J. Remedies
If Client breaches this Agreement (including failure to pay timely), Client is responsible for YDSPS’s reasonable attorney’s fees and costs to enforce this Agreement, whether or not litigation is filed.
B. Client Profile Details (Pets, Home, Emergency Contacts)
1. Profile Accuracy. Client affirms the Profile information is true, complete, and correct, and agrees to indemnify and hold harmless YDSPS and YDSPS Parties for damages to Pets, Client, Client’s property/home, sitter/YDSPS property, or third parties arising from inaccurate information.
2. Health Information. To Client’s knowledge, neither Client nor Pets have an illness transmissible to other people or animals through natural contact. If Client or Pets contract such an illness, Client will alert YDSPS immediately.
a. Rabies (Virginia). Client will provide and keep current on file with YDSPS proof of current rabies vaccination for all dogs and cats 4 months of age or older, as required by Code of Virginia § 3.2‑6521. Client will update the Vaccinations section of the Profile. (Please do not mail or leave records for the sitter; records may be uploaded, emailed, or faxed to 703‑962‑7222.)
b. Licenses. Client will keep all required pet licenses current.
c. Communicable Disease. Client certifies Pets are in good health and have not been ill with a communicable disease in the last 30 days and will notify YDSPS if Pets develop a communicable illness.
3. Pets in Household. Client will create a Profile entry in Precise Petcare for each pet in the household, including pets not scheduled for visits. Proof of rabies vaccination is required for all dogs and cats in the household as required by law.
a. Adding a Pet. Before service starts, Client will notify YDSPS and add the pet in the portal with current information and rabies proof. If Client fails to provide information, Client assumes responsibility for any issues; service may be suspended until provided. Records may be uploaded, emailed (petcare@yourdogsmiles.com), or faxed (703‑962‑7222).
b. Removing a Pet. Temporary/foster/family pets may be made inactive in the portal (or YDSPS can assist). If a pet returns, it can be reactivated. If a pet passes away, notify YDSPS; YDSPS will update the account, process any applicable refund, and arrange key pickup if needed.
4. Medications & Medical History. All medications (names, dosages, timing) and relevant medical history must be current in the Profile to ensure accurate care in emergencies.
a. List all meds, dosage amounts, and dosing times in the pet’s Profile.
b. List previous medical conditions/concerns in the pet’s Profile.
c. List at least one Emergency Contact who can assist with minor pet or home issues if Client is briefly unreachable.
d. Emergency Treatment Plan must name a trusted person (other than Client) who can take in the pet and make decisions if major treatment or a change in situation is required.
5. Behavior Information. Client will disclose in writing any previous displays of aggression or threatening behavior of ANY TYPE, including toward other animals or people, and will keep the Profile updated with observed behavior changes (fear, aggression, threatening behavior, etc.).
a. If a Pet displays aggression or threatening behavior of ANY TYPE during a sit that prevents safe care, and Client is unable to be present for 24+ hours and no safe alternative can be made, Client understands YDSPS may hire a trainer at Client’s expense to attempt to stabilize the situation and/or turn Pets over to animal control.
6. Cleaning Procedures/Solutions. Client will select and leave appropriate cleaners and instructions for sitters and keep details current in the Profile. Food dyes and bodily fluids can bleach/stain carpeting and are beyond YDSPS’s control.
7. Waste Disposal. Sitters use disposable bags to clean up after Pets and will dispose of waste in the designated location per the Profile.
8. Leashes. Client must provide non‑retractable leashes.
9. Harnesses/Control Devices. YDSPS may require a harness, Easy Walk or similar, for safety.
a. Shy/Collar‑Slip Dogs. A harness is required to prevent slipping a collar.
b. Pullers. A pull‑control device (e.g., Easy Walk, Easy Lead, prong collar, etc.) may be required for the safety of the Pet and sitter.
C. Scheduling & Cancellations
1. Scheduling. Schedule through the Precise Petcare portal. If you need help, email the office with visit details; no request is official without written confirmation from the office. Last‑minute requests are honored when possible and may incur a fee. For requests < 1 week, also call 703‑962‑7222.
2. Cancellations. Cancel through the portal. If you need help, email the office with cancellation details; no cancellation is official without office confirmation. If your request is < 48 hours, also call 703‑962‑7222.
3. Inclement Weather & Government Closures. If local government agencies close, YDSPS will cancel all mid‑day services. If a sitter cannot safely reach your home due to weather or unforeseen safety concerns, services may be modified or canceled based on the circumstances.
D. Entry to Your Home
1. Accepted Entry Methods. Keys in lockboxes, garage codes, and door codes.
a. You may provide your own lockbox.
b. Electronic Locks/Garage Openers. Provide a backup option in case of power loss.
c. Hidden keys and unlocked doors create significant safety and security risks. YDSPS’s safety policy prevents servicing clients with unsecured/hidden keys.
E. Billing, Payments & Refunds
1. Rates, Services & Notice. Client agrees to current rates/services. Rates/services may change with 30 days’ advance notice via email and posting on the YDSPS website.
a. Payment Due. Payment is due on receipt. Any payment received 15+ days from the service start date incurs a $50.00 late fee. Payments 30+ days overdue will incur an additional service charge of 20% of the then‑current amount due every thirty (30) days or the maximum permitted by law, whichever is lower, until paid in full.
b. Returned Payments. Returned checks and chargebacks incur a $50.00 fee.
c. Holiday/Day Surcharges (per visit).

St. Patrick’s Day (after 4pm): $8 per visit
Halloween (after 4pm): $8 per visit
d. Refunds/Credits. YDSPS does not refund payments. If a service is canceled in accordance with the cancellation policy, a credit will be applied to Client’s account for future service.
e. Monthly Statements. Mailed or emailed monthly statements are available for a $5.00/month processing fee. Invoices are always available in your online account at no charge.
f. Cancellation Policy.
Visits canceled between 9:00 PM and 9:00 AM prior to the visit: 50% cancellation fee.
Visits canceled after 9:00 AM on the day of service: 100% cancellation fee.
Holiday periods (Monday–Sunday before and after Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day, and New Year’s Day) require a 100% deposit at booking. All cancellations during these periods receive a 50% cancellation fee. Cancellations are non‑refundable and will be applied as a credit to future service, subject to the service’s cancellation policy.
g. Portal Requirement. All scheduling/cancellations must be completed through the Precise Petcare portal or by contacting the office—not through the sitter. Email confirmation may be requested.
h. Medical Emergencies. If Client’s specified veterinarian is unavailable, YDSPS may take Pets to the closest veterinarian or emergency facility. YDSPS will attempt to contact Client; if unreachable, YDSPS and the sitter may authorize the care the veterinarian deems necessary for the Pet’s health, safety, and survival. Client agrees to reimburse YDSPS for all related costs (which may include x‑rays, blood work, surgery, etc.) and an emergency medical transport fee. Pets must have current vaccinations.
i. Credit Card on File. Clients are required to keep a credit card on file for billing and emergencies while Pets are in YDSPS’s care.
j. Supplies/Concierge Purchases. If Pets run out of food, litter, meds, etc., YDSPS may purchase items using the card on file. A $40 per half‑hour concierge fee and a 10% service charge on items purchased apply. Client will be contacted prior for approval when feasible; additional service fees may apply.
k. Concierge Reimbursement. For concierge services, any items not prepaid and purchased by YDSPS will be reimbursed by Client within 24 hours and assessed a 10% service charge (and may be subject to other fees).
l. Monthly Rate Billing. Any client with 19 visits during a calendar month receives a discounted rate for that service. If cancellations drop visits below 19, the rate automatically adjusts to the regular rate for prior visits, resulting in a balance due. If visits increase to 19+, a credit for the difference applies to future visits.
m. Other Billing Frequency. Anything else is billed weekly.
n. Weekly Billing Cycle. Invoiced Friday and auto‑charged the following Wednesday. Weekly billing covers previously unbilled charges and current charges Monday through the following Sunday, including adjustments due to threshold changes or canceled services. Please ensure your card on file is current. A $2 service charge may be applied each time your card is declined after the first decline.
o. Checks by Mail. Clients mailing checks should send to: Your Dog Smiles Pet Services, LLC, PO Box 2385, Leesburg, VA 20177.
p. Meet & Greets. Required for new clients. First meeting with a manager: no charge. Meetings with a sitter or additional meet‑and‑greets: $35.00 per sitter, per occurrence. Meet‑and‑greets may be required for new pets with fears/anxiety, specific medical instructions, or upon Client moving to a new location. If YDSPS must substitute/change a sitter and Client requests a meet‑and‑greet, a $25.00 fee may be assessed.
q. Last‑Minute Scheduling/Rush. Visits scheduled ≤ 24 hours may receive a $6 last‑minute fee; ≤ 12 hours may receive a $12 fee. New client setups not complete (agreements, vaccinations, meet‑and‑greet) 48+ hours before start of service will receive an additional $35.00 rush fee. YDSPS is closed on weekends and holidays; services starting on a Monday or after a holiday must be complete 48 hours prior to Saturday to avoid a rush fee.
r. Refund Policy. YDSPS does not offer refunds for canceled services; if the service meets the cancellation policy, YDSPS will apply a credit to Client’s account for future services. If Pets become deceased before or during service periods, YDSPS will issue a refund.
F. Communication
1. Holidays. The YDSPS office is closed on all holidays.
2. Sitter Changes. Changes due to vacations, sick days, time off, or termination will be communicated via email with as much advance notice as possible.
3. Client Concerns. If you have any issue (sitter, billing, Pets, or anything else), contact YDSPS immediately so we can investigate and resolve it. If you feel we overbilled, tell us—we correct our mistakes.
G. Enforceability; Modification; Notices; Governing Law
1. Entire Agreement; Modifications. This Agreement contains the entire agreement between the Parties and may be changed only in a writing signed by the Parties. The Agreement may be executed in counterparts; faxed/scanned/electronic copies are deemed originals. Singular includes plural and vice versa. If any provision is unenforceable, the remainder remains in full force and effect.
2. Notices. Notices to YDSPS shall be sent to the contact information on YDSPS’s website unless otherwise indicated. Notices to Client shall be sent to the contact information in the Profile or other contact information provided by Client during this relationship.
3. Governing Law; Venue; Remedies. This Agreement is governed by the laws of the Commonwealth of Virginia. In the event of a dispute, Client agrees to the jurisdiction of Virginia courts and venue in a court of competent jurisdiction in Fairfax County, Virginia. In litigation, the substantially prevailing party is entitled to recover reasonable attorney’s fees, expert witness fees, and costs from the other party.

I, the Client, certify that I have read, understand, and will abide by this Agreement and YDSPS’s policies.
